World s Largest Shipping Association Adopts Clause To Address USTR Actions



BIMCO, the largest shipping association in the industry, has introduced a new standard clause to assist shipping companies in navigating the challenges posed by recent U.S. trade actions.

This clause aims to minimize legal confusion and contract disputes arising from the U.S. Trade Representative's (USTR) Notice of Actions targeting vessels linked to China arriving at U.S. ports.

Recently, the USTR announced plans to impose additional charges on ships that are built in China or owned and operated by Chinese entities. These measures are part of the USTR's Section 301 Investigation, focusing on China's efforts to dominate the maritime logistics and shipbuilding sectors.

The forthcoming fees are expected to affect not only Chinese-built vessels or those owned by Chinese companies but also any automotive carriers constructed outside of the U.S. This could significantly raise the costs associated with shipping goods to and from the U.S. and enhance regulatory authority within the global shipping industry.

In response, BIMCO quickly established a subcommittee comprising legal and commercial experts. This group commenced work on the new clause in early June, soon after the USTR's announcement, prioritizing the development of a solution to assist shipowners and operators in managing the risks and legal uncertainties stemming from the USTR's decision.

BIMCO’s Deputy Secretary General and Director of Contracts emphasized the importance of gathering input from a diverse range of industry professionals in a timely manner. She noted that the USTR’s actions are likely to create complex challenges, and the subcommittee meticulously deliberated on how to devise a solution that would help the shipping industry avoid disputes.

The Chairperson of BIMCO’s Documentary Committee remarked on the many uncertainties surrounding the enforcement of the USTR's Notice. He stated that once the fees are implemented and as the industry gains more experience, BIMCO will continue to review the clause to ensure it remains effective and meets the association's high standards.
